Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the ScanDent mobile application (“App”), related websites, and services (collectively, the “Service”) operated by ScanDent (“we”, “us”, or “our”). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
ScanDent uses artificial intelligence to analyze photos you submit and provide a cosmetic, informational dental score, visual insights, habit tracking tools, optional whitening simulations, and an Apple Watch companion (collectively, the “Service”) operated by ScanDent (“we”, “us”, or “our”). The Service is intended for entertainment and general informational purposes only.
2. Not medical advice
ScanDent is not a medical or dental device and does not provide medical diagnosis, treatment, or professional advice. Results are generated by automated systems and may be incomplete or inaccurate. Always seek advice from a licensed dentist or healthcare provider for any oral health concerns. Do not delay professional care because of information shown in the App.
3. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian.
4. Accounts and subscriptions
- Some features require a paid subscription (“ScanDent Pro”) or one-time purchase processed through Apple’s App Store.
- Payment, billing, renewal, cancellation, refunds, and free trials are handled by Apple under Apple’s terms. We do not process card payments directly.
- Subscription prices, trial length, and plan availability may change and may vary by region.
- Apple Watch companion app, plan sync, and brushing timer are included at no extra subscription cost on Watch.
5. Free tier and usage limits
We may offer limited free access (for example, a limited number of dental scans or food scans). We reserve the right to change free tier limits, features, or availability at any time.
6. Your content
You retain ownership of photos and other content you submit (“User Content”). By submitting User Content, you grant us a limited license to process it solely to provide and improve the Service — including transmitting images to our secure analysis infrastructure and third-party AI providers as described in our Privacy Policy.
You agree not to submit content that:
- Violates any law or third-party rights;
- Contains images of other people without their consent;
- Is abusive, fraudulent, or intended to misuse the Service or our API.
7. Acceptable use
You agree not to:
- Reverse engineer, scrape, or attempt to extract our models, prompts, or API keys;
- Circumvent usage limits, paywalls, or security measures;
- Use the Service for unlawful, harmful, or misleading purposes;
- Automate requests or overload our systems.
8. AI-generated output
AI outputs — including scores, observations, recommendations, and whitening previews — are probabilistic and may vary between sessions. Whitening simulations are cosmetic visualizations only and do not represent guaranteed real-world outcomes.
9. Intellectual property
The App, branding, design, and underlying software are owned by us or our licensors and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50.
12. Termination
We may suspend or terminate access to the Service if you violate these Terms or if we discontinue the Service. You may stop using the Service at any time by deleting the App.
13. Changes
We may update these Terms from time to time. We will post the revised version on this page and update the “Last updated” date. Continued use after changes become effective constitutes acceptance.
14. Governing law
These Terms are governed by the laws applicable in the operator’s jurisdiction, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country provide otherwise.
